JPS-WNC LLC FIVE (5) Year Limited Warranty Agreement for Residential Roofing Contracts

The commencement date of the warranty is from the date of the final project invoice and extends for a period of Five (5) calendar YEARS from that date.

WARRANTY COVERAGE ON JP SUPPLIED ROOFING

JPS-WNC llc (JP hereinafter) expressly warrants to the original Customer(s) of the home that any new roof that was installed by JP will be free from defects in materials and workmanship due to noncompliance with the standards as set forth in the Residential Construction Performance Guidelines published by the National Association of Home Builders (NAHB) and in effect on the date of this limited warranty, and as further defined within this warranty document.  The stated manufacturer’s warranty is in effect for the various roofing components supplied and installed by JP and the manufacturer is solely responsible for any defects in material or workmanship that are found within these manufactured products as long as the product was installed in accordance with the manufacturer’s specifications that were in effect when the specific roofing product was installed.

  1. JP ’S OBLIGATIONS REGARDING LABOR DEFECTS

If a covered defect occurs during the five (5) year warranty period that is a direct result of improper installation by JP, JP agrees to repair, replace, or pay the customer(s) the reasonable cost of repairing or replacing the defective item.  JP’s total liability under this warranty is limited to the purchase price of the portion of the project that is defective as stated above.  The choice among repair, replacement, or payment is to be made solely by JP.  Any steps taken by JP to correct defects shall not act to extend the term of this warranty.  All repairs by JP shall be at no charge to the customer(s) and shall be performed within a reasonable length of time after the receipt of a written description of the alleged defect and expectation.

  1. OWNER’S OBLIGATION

The Customer(s) must provide normal maintenance and proper care of the roofing products included in this warranty, in accordance with the generally accepted standards for homes located within the State of North Carolina.  Any products provided by the customer or others is specifically excluded from this warranty coverage. JP must be notified in writing via an email to JP@jpswnc.com by the Customer(s), of the existence of any defect before JP is responsible for the correction of that defect.  Written notice of a defect must be received by JP prior to the expiration of the warranty on that defect and no action at law or in equity may be brought by the Customer(s) against JP for failure to remedy or repair any defect about which JP has not received timely notice in writing.  Customer(s) must provide access to JP during its normal business hours, Monday through Friday, 8:00 a.m. to 5:00 p.m., to inspect the defect reported and, if necessary, to take corrective action.

  1. EXCLUDED ITEMS:

Any pre-existing damage or installation defects which are below or above the roof decking line are the responsibility of the customer unless specifically included in the contractual documents.  This includes, but is not limited to, rafter condition, siding deterioration, wood rot, chimney defects, dormer defects, or issues related to the existing siding, fascia, or eaves.   The repair of any damage to wet wood or damaged siding immediately adjacent to any roof line is the not the responsibility of JP.

  1. INSURANCE

In the event JP repairs or replaces or pays the cost of repairing or replacing any defect covered by this warranty for which the Customer(s) is covered by insurance or a warranty provided by any other party, Customer(s) must, upon request of JP, assign the proceeds of such insurance or other warranty to JP to the extent of the cost to JP of such repair or replacement.

  1. CONSEQUENTIAL OR INCIDENTAL DAMAGES EXCLUDED

CONSEQUENTIAL OR INCIDENTAL DAMAGES ARE NOT COVERED NOR INCLUDE IN THIS WARRANTY.

  1. OTHER EXCLUSIONS

THE FOLLOWING ADDITIONAL ITEMS ARE EXCLUDED FROM LIMITED WARRANTY:

  1. Defects in any item that was not part of the original scope of work as provided by JP.
  2. Any defect caused by or worsened by negligence, improper maintenance, lack of maintenance, improper action or inaction, or willful or malicious acts by any party other than JP , its employees, or JP installation sub-contractors.
  3. Normal wear and tear of the home or any consumer products within the home.
    d. Loss or damage caused by “Acts of God”, including but not limited to fire, explosion, smoke, water leakage or escape, ice dams, changes that are not reasonably foreseeable in the level of underground water table, glass breakage, windstorm, hail, lightning, falling trees, aircraft, vehicles, flood, and earthquakes or any other “Acts of God” damage.
  4. Any loss or damage that arises while the home is being used primarily for non-residential purposes.
  5. Any damage to the extent it is caused or made worse by the failure of anyone other than JP, or our installation trade sub-contractors, to comply with the requirements of this warranty or the requirements of warranties of manufacturers.
  6. Any defect or damage that is covered by a manufacturer’s warranty that has been assigned to Customer(s) under paragraph 2 of this Limited Warranty.
  7. Failure of Customer(s) to take timely action to minimize loss or damage or failure of Customer(s) to give JP timely notice of the defect.
  8. Insect or animal damage.
  9. ARBITRATION OF DISPUTE

The Customer(s) shall promptly contact JP’s Owner regarding any disputes involving this Agreement.  If normal discussions between the parties do not resolve such dispute, either party may, upon written notice to the other party, submit such dispute for resolution in accordance to the terms and conditions specified in JP’s standard terms and conditions.  Negative disclosures to any third party (other than legal counsel) relating to our work is not permissible at any time and for any reason..  Refer to terms and conditions for more detail.

  1. EXCLUSIVE WARRANTY

JP AND THE CUSTOMER(S) AGREE THAT THIS LIMITED WARRANTY ON THE HOME IS IN LIEU OF ALL WARRANTIES OF HABITABILITY OR WORKMANLIKE CONSTRUCTION OR ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, TO WHICH CUSTOMER(S) MIGHT BE ENTITLED, EXCEPT AS TO MANUFACTURER’S PRODUCT WARRANTIES.  NO ONE OTHER THAN THE JP OWNER HAS THE AUTHORITY TO CHANGE THE TERMS OF THIS FIVE YEAR LIMITED WARRANTY.
